Florow Terms and Conditions of Service

Florow provides website design and development services according to customer requirements, such as personal websites, business websites, or other web development related projects. Currently, our services operate through one-on-one collaboration with clients, where project details, service fees, and timelines are agreed upon case by case. We are committed to providing professional services as agreed upon.

Florow's website is created to serve as a channel for providing information about our services, news, and articles beneficial to service users. Our main user base is Thai, but some content may be in English to accommodate diverse users.

In the future, Florow may add new features or services to the website, such as user registration systems, online project management systems, or online payment systems. The use of these features will be subject to these terms and may have additional conditions that will be announced when such features are launched.

Age Note: Florow's services have no age restrictions for users. Users of all ages can use our services. However, if users are under 20 years old, they should obtain parental consent before using the services.

Provide services as agreed: Florow will provide services according to the agreed scope of work and timeline with customers to the best of our ability and responsibility.

Notify problems or delays: If there are obstacles, delays, or changes in service provision, Florow will notify customers as soon as possible.

Data confidentiality: Florow values customer privacy. Information provided by customers or arising from service use will be kept confidential according to Florow's privacy policy and will not be disclosed to third parties without consent, except as specified in the policy or as required by law.

Right to refuse inappropriate work: Florow reserves the right to refuse work or projects with illegal content, contrary to morals, or beyond our expertise, and will provide reasons to customers when possible.

Service improvements/temporary suspension: Florow has the right to improve, change, suspend, or temporarily stop providing certain website services for maintenance or system improvements. We will try to notify users in advance if such changes affect user experience.

Intellectual property: Tools or resources used in website development (such as software, plugins, templates, or images) may be under third-party copyright. Florow will use these resources properly according to our rights. For website work delivered to customers, ownership rights will be according to agreements made with customers case by case. Generally, customers will own the developed website, and Florow may request permission to showcase some work as our portfolio examples.

Provide accurate information: Users must provide true, accurate, and complete information when contacting for services or when registering accounts (if any) and should update their information if there are changes.

Proper usage: Users agree to use Florow's website and services for lawful purposes and according to these terms. They will not use services illegally, immorally, or in violation of others' rights.

User account management: If accounts are created, users must keep their usernames and passwords confidential and be responsible for activities under their accounts. If unauthorized account use is discovered, users must immediately notify Florow.

Service payment: Users agree to pay service fees in full according to agreed amounts and deadlines. If users fail to pay on time, Florow may temporarily suspend services or delay work delivery until payment is received.

Respect intellectual property: Users must not copy, modify, use, or distribute content, images, logos, software, or any components from Florow's website for commercial purposes without prior permission.

Problem reporting: If users encounter problems or defects in service use, they can notify Florow so we can take corrective action.

Service fees for website development and other Florow services will be determined according to work difficulty and scope, which both parties will agree upon before starting work. Currently, payments are processed offline (such as through bank transfers or agreed methods) until an online payment system is available on the website in the future.

Advance and post-delivery payments: Generally, Florow may collect deposits before starting work and collect the remainder after work completion. Details of amounts and deadlines will be provided in advance and specified in agreements or invoices.

Additional costs: If there are changes or additions beyond the agreed scope that incur additional costs, Florow will notify customers of additional expenses and proceed only after receiving customer consent.

Late or non-payment: If customers pay late or fail to pay on schedule, Florow may suspend work or delivery until full payment is received. Customers may be responsible for late payment fees (if specified).

Refund policy: Paid service fees generally cannot be refunded, except when Florow cannot provide services as agreed. If customers cancel projects after work begins, Florow reserves the right to charge for completed work or deduct deposits to compensate for time and resources used.

User cancellation: Users can terminate service use at any time. If user accounts exist, users can request Florow to close accounts. When accounts are cancelled, your data stored in the system (if any) may be deleted or made unusable, except data we need to retain according to law or Florow's privacy policy.

Termination by Florow: Florow may temporarily or permanently suspend or terminate services to users if found to violate these terms or use services illegally or in ways that damage Florow or others. In some serious cases, Florow may not be able to provide advance notice.

Effects of termination: When services end, users still have obligations to pay outstanding service fees (if any) and Florow will not be liable for any losses or damages to users from service termination, except as required by law. Terms regarding liability limitations and intellectual property will remain in effect after contract termination.

As-is services: Florow provides services and information on the website as-is, without guaranteeing that services will meet all user requirements or be free from errors or other disruptions. Users should use discretion when using services.

No liability for certain damages: Florow will not be liable for direct, indirect, incidental, consequential, or punitive damages arising from use of our services or website, including loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages.

Scope of liability: If for any reason Florow is determined to be liable for damages to users, such liability will be limited to no more than the service fees users have paid to Florow for work or services that caused such damages.

Force majeure: Florow is not liable for delays or inability to provide normal services due to force majeure or events beyond our control, such as natural disasters, technical failures, internet problems, or various emergencies that cause service interruptions.

User risk: Using Florow's services is at the user's own risk. Users must be responsible for protecting their devices and data from damage that may occur from using our website or services (such as virus damage).

These terms are governed by and interpreted according to Thai law. In case of disputes, users and Florow consent to be under the jurisdiction of Thai courts.

If any provision in these terms conflicts with law and is void or unenforceable, that provision shall be severed from these terms without affecting the enforceability of other provisions.
